I agree to participate in one or more physical fitness program(s)/class(es) sponsored by CrossFit Muzzle, or partnership of CrossFit Muzzle and/or its agents, employees, officers, managers or members (hereinafter collectively referred to as CrossFit Muzzle). CrossFit Muzzle made me fully aware that the fitness programs/classes that CrossFit Muzzle offers and in which I desire to participate are of a nature and kind that are extremely strenuous and can/may push me to the limits of my physical abilities.
I, the undersigned, acknowledge and agree that the programs/classes are not without varying degrees or risk which may include, but are not limited to the following: Injury to the musculoskeletal and/or cardio respiratory systems which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, injury or death due to improper use or failure of equipment, or injury or death due to a medical condition, whether known or unknown by me. I am aware that any of these above mentioned risks might result in serious injury or death to myself to as a result of my participation in CrossFit Muzzle programs/classes and accept full responsibility for any injury or death that may result from participation in any activity, class or physical fitness program. I hereby certify that I know of no medical problems that would increase my risk of illness and injury as a result of participation in a fitness program designed by CrossFit Muzzle. CrossFit Muzzle has informed me that there exists the possibility of adverse physical changes during the exercise program, and I fully understand the same. CrossFit Muzzle informed me that these changes could include, but are certainly not limited to, abnormal blood pressure, fainting disorder or heart rhythm, stroke, and heart attack or even death, and I fully understand the same. With my full understanding of the above information, I agree to assume any and all risk associated with my participation in CrossFit Muzzle fitness program/classes.
I acknowledge that CrossFit Muzzle encouraged me to consult a medical professional to ensure I was physically able to participate in the type of fitness program designed by CrossFit Muzzle. If I am signing on behalf of a minor child, I acknowledge that I was encouraged to have the child evaluated by a medical professional to ensure the child is physically able to participate in CrossFit Muzzle’s activities. If I am signing on behalf of a minor child, I also give full permission for any person connected with CrossFit Muzzle to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the wellbeing of the child.
I understand that CrossFit Muzzle prohibits the use of any drugs or steroids and agrees not to use any drugs or steroids on CrossFit Muzzle’s premises. Member acknowledges and is aware that steroids can cause numerous physical, mental and emotional problems relating to physical maturity and growth and may cause heart disease, strokes, liver dysfunction, sterility, infertility, and many other adverse health problems.
I agree that in full consideration for permission to enter onto CrossFit Muzzle’s premises and permission to participate in the activities made available by CrossFit Muzzle, of which I voluntarily seek to participate, and with my full understanding of the above risks and hazards, I, for myself, executors and assigns, waive and release CrossFit Muzzle, its respective owners, officers, affiliates, volunteers, agents and employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct any sponsored event (Releasees), from any liability, whether, for death, personal injury or property damage arising out of my participation in CrossFit Muzzle programs/classes, whether arising from negligence of the releases or otherwise, and agrees to hold CrossFit Muzzle free, clear and harmless from any claims, demands, including attorney’s fees, or for contribution or indemnity, and reasonable and necessary costs incurred in defense of any claim or claims for personal injury or property damage arising out from membership and activities at CrossFit Muzzle. I agree to assume whole financial responsibility for any injury that the participant or I may cause either to him/herself or to any other participant due to his/her negligence.
I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of Texas and if a portion of this release is held invalid, the remainder shall remain in full force and effect. This release shall apply to my heirs, assigns, personal representatives and any other next of kin. I understand that CrossFit Muzzle is relying on this release in agreeing to enter into this agreement. If any part of this agreement is held invalid, I agree that the remainder will remain in full force and effect.
Arbitration
All disputes (except small claims under $1,000) will be settled by binding arbitration before a single arbitrator pursuant to the Federal Arbitration Act, conducted by and in accordance with the rules and procedures of the American Bar Association. The decision of the arbitrator will be final and binding on all parties and may be enforced by a judgment entered upon the arbitration award by any state or federal court in this state.
This Agreement may not be amended or modified except by any instrument in writing executed by the parties hereto.
